When you contact us, request information, become a client, or otherwise interact with Lavatr, we may collect information such as:

• information you provide through forms, email, meetings, or other communications.

Client Content and Production Materials

When you engage Lavatr to provide Services, we may receive and process materials necessary to perform those Services, including:

• photographs and images;

• video recordings;

• audio and voice recordings;

• scripts and written content;

• logos, trademarks, and brand materials;

• documents and other production materials;

• content strategies, plans, instructions, and feedback; and

• other information provided by or on behalf of the client.

Image, Voice, Likeness, and Avatar Materials

Certain Lavatr Services involve creating or managing an authorized AI avatar, digital twin, synthetic voice, or similar digital representation.

For these Services, clients may provide photographs, video recordings, audio recordings, voice samples, facial imagery, likeness information, and consent or verification materials.

Lavatr does not claim ownership of a client’s identity, image, voice, or likeness.

These materials are processed only as reasonably necessary to provide the authorized Services, including transmitting them to applicable technology providers that perform the underlying avatar, voice, or video-generation functions.

Lavatr will not intentionally use a client’s image, voice, likeness, AI avatar, or digital twin to create content unrelated to the client’s engagement or for purposes not authorized by the client.

Website and Usage Information

When you visit our Site, certain information may be collected automatically, including:

• IP address;

• browser and device information;

• operating system;

• referring pages or URLs;

• pages viewed and interactions with the Site;

• approximate location derived from IP address; and

• cookies and similar technologies.

2. How We Use Information

Lavatr may use information to:

• provide, operate, and improve our Services;

• communicate with clients and prospective clients;

• create and manage authorized AI avatars and digital twins;

• develop content strategies, scripts, videos, and other client deliverables;

Lavatr does not use a client’s AI avatar, digital twin, voice, or likeness to independently generate unrelated content, endorsements, opinions, or communications outside the scope of the client engagement without additional authorization.

3. AI and Third-Party Technology Providers

Lavatr is an AI-powered communication and content agency. We provide strategy, creative, production, implementation, and managed services while relying on third-party technology providers for certain underlying technological capabilities.

HeyGen

Lavatr currently uses HeyGen for certain AI avatar, digital twin, voice, and video-generation capabilities.

When a client engages Lavatr for these Services, Lavatr may upload or otherwise provide authorized client materials to HeyGen, including photographs, videos, audio, voice recordings, facial imagery, likeness information, scripts, and related content necessary to create and operate the authorized avatar and generate client content.

The underlying avatar and related AI processing occurs through HeyGen’s technology platform.

HeyGen maintains its own privacy and data-processing practices. Clients and individuals who would like additional information about how HeyGen handles information may review:

Lavatr’s use of HeyGen may change over time, and we may add or use alternative technology providers as our Services and available technologies evolve.

Other Service and Technology Providers

Lavatr may use additional third-party providers to support activities such as:

• video and audio editing;

• content production;

• cloud storage and file sharing;

• email and communications;

• website hosting;

• analytics;

• payment processing; and

• other business and production functions.

We provide these parties access to information only as reasonably necessary for them to perform the applicable services.

4. How We Share Information

Lavatr does not sell personal information for monetary consideration.

We may disclose information in the following circumstances:

Service and Technology Providers

We may provide information to technology providers, contractors, vendors, and other service providers that help us operate our business and provide the Services.

This includes providers that process Client Content on our behalf or provide underlying AI, avatar, voice, video, editing, storage, hosting, communications, analytics, payment, or production technology.

At Your Direction

We may disclose or use information when a client requests, directs, authorizes, or consents to the disclosure or use.

Legal and Safety Requirements

We may disclose information when reasonably necessary to comply with applicable law, regulation, legal process, or governmental request; enforce our agreements; investigate fraud or security issues; or protect the rights, property, or safety of Lavatr, our clients, or others.

Business Transactions

If Lavatr or its business is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction, information may be disclosed or transferred as part of that transaction, subject to applicable law and appropriate confidentiality protections.

5. Client Data and Our Role

When Lavatr processes personal information provided by an individual directly for our own business purposes, Lavatr may determine how and why that information is processed.

When Lavatr processes personal information on behalf of a business client in order to provide contracted Services, the business client generally determines the purpose of the processing and Lavatr processes the information in connection with the client’s instructions and the Services being provided.

Business and enterprise clients may request Lavatr’s Data Processing Addendum (“DPA”), which provides additional terms governing the processing of personal information on their behalf.

Lavatr may use authorized technology providers to assist with this processing. Where applicable, these providers may act as subprocessors in connection with the Services.

6. Consent and Authorization

Clients are responsible for ensuring that they have the rights, permissions, and consents necessary to provide Client Content to Lavatr and authorize its processing.

When an individual provides Lavatr with photographs, video, audio, voice recordings, likeness information, or other materials for the creation of their own AI avatar or digital twin, those materials will be used to provide the authorized Services.

If a business client asks Lavatr to create or manage an AI representation of an employee, executive, spokesperson, contractor, or another individual, the business client is responsible for ensuring that appropriate authorization and consent have been obtained.

Additional consent or identity verification may be required by Lavatr or the applicable technology provider before an avatar or digital representation can be created.

Lavatr’s AI avatar and digital twin Services are intended for adults. Lavatr does not accept photographs, video, audio, voice recordings, or likeness materials of minors for the creation of AI avatars or digital twins.

7. Data Retention and Deletion

Lavatr retains personal information and Client Content only for as long as reasonably necessary to provide the Services, maintain client projects and business records, comply with contractual and legal obligations, resolve disputes, enforce agreements, and support legitimate business purposes.

Retention periods may vary depending on the type of information and the nature of the Services.

Client production materials, including photographs, video, audio, voice recordings, consent materials, and other source content, may be retained while reasonably necessary to provide or support the client’s Services.

Clients may request deletion of personal information or production materials held by Lavatr, subject to applicable legal, contractual, security, backup, and operational requirements.

Information processed by third-party technology providers may also be subject to those providers’ applicable retention and deletion practices.

8. Data Security

Lavatr uses reasonable administrative, technical, and organizational measures designed to protect personal information and Client Content against unauthorized access, loss, misuse, alteration, or disclosure.

We also rely on third-party technology and service providers to maintain appropriate security measures for information they process on our behalf.

However, no method of electronic transmission, storage, or processing can be guaranteed to be completely secure.

9. Cookies and Website Analytics

Lavatr may use cookies and similar technologies to operate the Site, understand how visitors interact with it, improve performance, and support analytics.

Depending on the technologies used on the Site and your location, you may have options to control certain cookies through your browser or other available privacy controls.

Disabling certain cookies may affect how some portions of the Site function.
